Web Services Terms

Introduction
If You are Reading the Terms of Services, you must agree the previous Terms & Conditions for the accessing the Web Site and must go through our Privacy Policy.
Efficient INDIA requires all Customers / Resellers to be good Citizens of the Internet.
We do not tolerate SPAM (unsolicited commercial Email).

The following activities are expressly prohibited:

SPAM / Unsolicited Commercial Email (UCE) Do not SPAM, facilitate SPAM or allow your customers to SPAM. Do not host, or allow to be hosted, any sites or information that is advertised by SPAM from other networks. Violation of this policy carries severe penalties and will be pursued to the fullest extent possible including criminal and civil prosecution.
We understand that there will be a few complaints any time large quantities of Email are sent. However, Efficient INDIA must respond promptly to SPAM complaints in order to prevent our IP address space from being blocked.
Your service will be disconnected without refund if:
You don't have an opt-in list. We expect you to be able to respond to complaints with the source of the person's Email address who complained. The use of "harvested" email lists where addresses have been taken from web sites is grounds for immediate termination of service. You don't have a removal process that permanently removes recipients from your lists and sends confirmations via Email. You forge header information or improperly identify the sender. You don't respond to inquiries from Efficient INDIA Abuse within one business day. If we must further process SPAM complaints. In the event that emergency action is required by Efficient INDIA to resolve actions by anti-SPAM organizations to blacklist Efficient INDIA IP addresses or other threats to the Efficient INDIA you will be charged at our emergency rate of $200. Do not setup an open mail relay that is not password protected that can allow spammers to send SPAM. Please contact us if you have questions.

Hacking or any perpetration of security breaches.

Illegal activities.

Child pornography or any activities harmful to minors.

Fraudulent activity

Trademark or Copyright infringement including use or distribution of pirated software.

Utilization of Microsoft software that is not properly licensed.

Network attacks or any unfriendly effort to effect service on another network or server.

Virus distribution.

Adult Material
Adult materials are NOT allowed to be hosted on our servers. However they must be legally owned by you or you have the right to re-distribute them. Sites found that contain any illegal adult materials will be suspended or terminated immediately.

Game ROMs, copyrighted MP3s, warez, software cracks distribution.
IRC activity linked to any major IRC network.

Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

Network security and Server Abuse: Any attempt to undermine or cause harm to the server(s), or customer(s), of Efficient INDIA NETWORK.

Reseller: Client Responsibility
Resellers are responsible for supporting their clients.Efficient INDIA does not provide support to our Reseller's Clients. If a reseller's client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients' behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients'. Efficient INDIA will hold any reseller responsible for any of their clients actions that violate the law or the terms of service.

Mass mailing:
Efficient INDIA does not host any account specialize in mass mailing of any sort. Each account is only allowed to send 50 email messages per 10 minutes, any further email messages sent will be blocked. This limit is more than enough for normal web sites which maintain small scale mailing lists. If your account would/does exceed this limit, you should outsource your mailings to a 3rd party provider. Other than that, if for any reason the mass mailing activity is affecting the performance of our servers, the associated account(s) will be terminated immediately. Resellers are responsible for enforcing the AUP and TOS to all of their clients. If their clients are found to be not following them, Efficient INDIA will suspend the offending site and let the reseller know. Resellers are responsible for anything their clients do. Investigations, disruptions to service, no refunds:

We reserve the right to disable service or terminate service and / or remove content in order to investigate suspected violations of this AUP without first giving notice.
You are responsible for the use of your account, including transfer and bandwidth, even used by unauthorized users or hackers. Please note that this AUP is subject to change and it is the Customer's responsibility to regularly check for modifications. Efficient INDIA does not issue refunds for terminating service due to suspected AUP violations.

What the privacy policy cover
This policy covers how Efficient INDIA, treats personal information about you that we collect and receive, including information related to your past use of our products and services. "Personal information" is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.  The other information such as Internet protocol (IP) address, navigation through site, the system and time spent, along with other similar information, may be stored on our servers that identify you.

All information provided will be used for internal administrative uses only. We will not disclose, sell, share or in any way reveal your information to any other third party.
